Terms of Service

These Terms of Service (“Terms”) govern your access to and use of RookHelm, the community and game server management platform operated by RookHelm LLC, a Wyoming limited liability company (“RookHelm”, “we”, “us”). By creating an account or using the service, you agree to these Terms on behalf of yourself and, where applicable, the organization you represent.

Eligibility

You must be at least 13 years old to create an account. If you live in the European Union, you must meet the minimum age set by your member state, which may be up to 16. We do not knowingly collect personal data from children under 13. If we learn that an account holder is under the minimum age, we will close the account and remove the associated personal data.

Acceptable Use

You agree not to:

• use the service to store or distribute content that is illegal in the United States or in your jurisdiction;
• scrape, crawl, or otherwise extract data from the service by automated means, except through interfaces we document for that purpose;
• resell, sublicense, or bundle the service into your own commercial offering without a separate commercial license from us;
• interfere with the operation or security of the service, or access another organization’s data without authorization.

We may suspend accounts or remove content that violates this section.

Ban Records and Community Content

Ban records, moderation notes, and related evidence are contributed by the community operators who create them. They represent the opinion of the submitting operator, not a statement of fact by RookHelm. RookHelm stores and processes these records on behalf of operators and is not the publisher of operator-submitted content. How we handle personal data in these records is described in our Privacy Policy and, for organizations that require it, our Data Processing Addendum.

Fees and Refunds

Paid plans are billed monthly in advance at the prices shown on our pricing page. Subscriptions are non-refundable; when you cancel, your plan stays active until the end of the current billing period and you are not charged again. We will notify you before any price change takes effect.

Service Availability

We target 99.5% monthly uptime. This is a target, not a guarantee, and it carries no service credits. Where a separate written agreement, such as a hosting partner agreement, sets service levels, that agreement governs.

Limitation of Liability

To the maximum extent permitted by law, RookHelm’s total aggregate liability arising out of or relating to the service is limited to the fees you paid to us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. The service is provided “as is” without warranties of any kind, express or implied.

Indemnification

Each party will defend and indemnify the other against third-party claims arising from its breach of these Terms or its unlawful use of the service. Each party’s indemnification obligation is subject to the limitation of liability above.

Termination

You may stop using the service and close your account at any time. Either party may terminate these Terms for material breach if the breach is not cured within 30 days of written notice. We may suspend the service immediately where necessary to protect the service or other customers, or where required by law. On termination your right to use the service ends; data export and deletion are handled as described in the Privacy Policy.

Changes to These Terms

We may update these Terms from time to time. If a change is material, we will notify account holders by email or an in-product notice before it takes effect. Continued use of the service after a change takes effect constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict of law rules. Courts located in Wyoming have exclusive jurisdiction over disputes arising from these Terms, and each party consents to personal jurisdiction there.
